1. Introduction

These Terms of Service ("Terms") govern your use of WhateverNote, available at whatevernote.com and through our desktop and web applications. By using WhateverNote, you agree to these Terms.

2. Service Description

WhateverNote is a note-taking application with real-time synchronization across devices. It is available as a desktop application (Windows) and as a web application. The service uses CRDT-based sync technology to keep your notes consistent across all your devices.

3. Accounts

To use WhateverNote, you must sign in using a Google or Microsoft account. You are responsible for maintaining the security of your account. Each account is intended for use by a single person.

4. Your Content

You retain full ownership of all content you create in WhateverNote. We do not claim any intellectual property rights over your notes or other content. We store and synchronize your content solely to provide the service. We do not sell, share, or access your content for any purpose other than delivering the service to you.

5. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the service or its infrastructure
• Use the service to distribute malware or other harmful content

6. Service Availability

WhateverNote is provided "as is". While we strive to maintain high availability, we do not guarantee uninterrupted access to the service. There may be periods of maintenance or downtime. Thanks to WhateverNote's offline-first design, your notes remain accessible locally on your device even when the sync service is unavailable.

7. Pricing & Payment

WhateverNote's pricing is as listed on our website. We reserve the right to change pricing with reasonable notice. Any changes will not affect active subscription periods that have already been paid for.

8. Limitation of Liability

To the maximum extent permitted by applicable law, WhateverNote and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities. Our CRDT-based sync and local-first architecture are designed to minimize the risk of data loss, but we cannot guarantee against all possible scenarios.

9. Termination

You may stop using WhateverNote at any time. We may suspend or terminate your access if you violate these Terms. In case of termination, we will make reasonable efforts to allow you to export your data before access is removed.

10. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of the service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Italy.
